Your Clearinghouse Compliance Checklist

Implementing the new FMCSA Drug & Alcohol Clearinghouse regulations correctly so you stay compliant is definitely your top concern right now. To make sure you’ve got all your trucks in a row, take a quick run through our Clearinghouse Compliance Checklist to ensure your process includes everything you need.

You’re compliance-focused, and so is our software. We develop it specifically around the trucking industry’s rules and regulations to help you stay compliant. We also make life with the Clearinghouse easier for you in the following four ways:

  1. Driver Awareness – instantly notifying drivers when they need to register or provide consent;
  2. Recruiting – with support from a dedicated, in-house, full query clearinghouse team;
  3. Onboarding and Communications – providing reminders, notifications, and education to drivers;
  4. Safety – for easy and automated annual bulk limited query ordering, adverse action support, and DQF custom alerts and reporting.

Clearinghouse Compliance Checklist:

  1. Register with the FMCSA Clearinghouse (www.clearinghouse.fmcsa.dot.gov)
  2. Designate Tenstreet as your TPA
  3. Make sure you have purchased a query plan in the Clearinghouse
  4. Understand your obligations:
    • Pre-hire : employer must conduct a full query showing driver is not prohibited
      • Electronic consent given by the driver directly to the Clearinghouse to release information
    • Annually: employer must conduct limited query annually for all current employees
      • Written consent for limited query signed by driver outside of the Clearinghouse (can be electronic)
      • If limited query shows the presence of information in the Clearinghouse, full query must be conducted within 24 hours
    • Check out our previous blog post as well as our webinar for more information.
  5. Implement a Limited Query Consent on the signature portion of your Intelliapp:
    • Get it signed by all your current drivers and all your new hires so you’re ready when its time to conduct the annual limited query
    • Save the limited query consent in the DQF
  6. Make sure you retain all results from the Clearinghouse in the DQF
  7. Update your list of consumer reporting agencies for the 1681m Notice and California disclosure to include the FMCSA Clearinghouse contact information
  8. Add the FMCSA Clearinghouse contact information and the Clearinghouse results to your adverse action letters
  9. Make sure your employee drug and alcohol policies and training include the Clearinghouse information to comply with 49 CFR 382.601 obligations
